Litigation Services for Real Estate Fraud
As part of Arxis Financial’s “Litigation Consulting” practice, we regularly work with attorneys on real estate fraud matters. Along with the fall in real estate values, a related consequence has been increased litigation alleging fraud, typically initiated by lenders, regulators and investors.
Real estate fraud litigation is usually expensive, complex and dependant on the use of experts. The type of litigation dictates the evidence that may be required and the usage of experts. For example, Arxis Financial works in litigation by banks and regulators against borrowers, including false loan applications, misrepresentation of income, appraisal fraud, improper diversion of loan proceeds, etc. We also provide expert assistance in investor-related litigation, typically when non-control partners or investors become unhappy or suspicious of the handling of their investments.
Our forensic and fraud accountants serve a critical role in both plaintiff and defense matters. We have extensive experience in determining the necessary documentation, discovery approaches, and management of these documents. We then evaluate, analyze, summarize, and present the evidence. In conjunction with Arxis Financial's experts, the attorney can assess whether fraud occurred, the legal and financial viability of the case, and the best litigation strategy.

Mr. Hamilton is a Certified Public Accountant, Certified Fraud Examiner, Certified Valuation Analyst, and a Diplomate with the American Board of Forensic Accounting. He is a licensed life and disability insurance agent and a General Securities Representative. Mr. Hamilton has published articles in several publications, and has made presentations at national conferences, training institutes and seminars on topics including forenisc accounting, fraud and business appraisal.
